Terms of Service

The rules for using JoinGroupTour. We are a marketplace: operators run the trips, we handle discovery and booking.

1. What this platform is

JoinGroupTour is an online marketplace. Independent travel operators publish group tours; travellers book a seat on those tours. The contract for the trip itself is between you and the operator.

We are responsible for the booking platform, payment handling and for the operator verification we describe on this site. We are not the tour operator and do not ourselves transport, accommodate or guide travellers.

2. Eligibility

You must be 18 or older to make a booking. If you book for other travellers, you confirm you are authorised to do so and to share their details with the operator.

3. Booking a seat

A booking is confirmed when payment is received and the operator's departure is confirmed. Departures marked 'guaranteed' run regardless of headcount. Other departures require a minimum number of travellers.

Where a departure is cancelled by the operator for any reason, including a minimum headcount not being met, the Cancellation & Refund Policy governs what you receive. No other refund entitlement is promised here.

4. Prices

Prices are shown per seat, in Indian Rupees, on the sharing basis stated on the listing. Inclusions and exclusions are published by the operator on each trip page. Anything listed as excluded is payable by you.

5. Your conduct on a trip

Operators may refuse carriage or remove a traveller whose conduct endangers others, and may require you to follow safety instructions, particularly at altitude. No refund is due where you are removed for such conduct.

6. Our liability

We are liable for our own platform and payment obligations. We are not liable for the operator's performance of the trip, beyond our obligations under applicable consumer law.

Nothing in these terms limits liability that cannot be limited under the Consumer Protection Act, 2019.

7. Grievances

Complaints go to our Grievance Officer — see the Grievance Redressal page. We acknowledge within 48 hours and aim to resolve within one month, as required by the Consumer Protection (E-Commerce) Rules, 2020.

8. Accounts and accurate information

You are responsible for the accuracy of every traveller detail you submit, and for keeping your login credentials secure. Names, ages and ID details must match the document the traveller will carry — an operator may refuse travel where they do not, and no refund is due in that case.

You may not create an account on behalf of someone else without their authority, use the platform to book with an intent you have misrepresented, or attempt to interfere with the platform's operation or security.

9. Cancellation by you

Cancellations are governed by the Cancellation & Refund Policy and by the operator's published terms on the trip page, which are shown before you pay.

10. Intellectual property

The platform, its software, branding and compiled content are owned by [Registered legal name — NOT SET] or its licensors. Operators retain rights in the trip content they publish and grant us a licence to display it. Destination photography is licensed from third parties and credited on the Photo Credits page.

You may not scrape, republish or resell listings, pricing or content from this platform.

11. Limitation of liability

The trip is performed by the operator. Our liability to you for any claim connected with a booking is limited to the platform fees we received on that booking, except where the loss was caused by our own negligence, fraud or wilful misconduct.

We are not liable for indirect or consequential loss, including missed connections, lost earnings or lost enjoyment.

Nothing in these terms limits or excludes any liability that cannot lawfully be limited, including rights under the Consumer Protection Act, 2019, and nothing here requires you to waive a statutory right.

12. Indemnity

You agree to indemnify us against loss arising from your breach of these terms, from details you supplied that were untrue, or from your conduct on a trip.

13. Force majeure

Neither we nor an operator is liable for failure to perform caused by events outside reasonable control, including natural disaster, extreme weather, road or pass closure, epidemic, strike, civil unrest, or an act or order of government. Where a trip is affected, the Cancellation & Refund Policy applies.

14. Suspension and termination

We may suspend or close an account that breaches these terms, that we reasonably suspect of fraud, or where we are required to by law. Bookings already paid for are honoured or refunded in line with the refund policy.

15. Changes to these terms

We may amend these terms. The version in force when you make a booking governs that booking. Material changes are notified on this page with a revised date, and by email where we hold one.

16. Grievances and dispute resolution

Complaints go first to our Grievance Officer, who acknowledges within 48 hours and responds within one month.

If a dispute remains unresolved, it may be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated at our place of jurisdiction, conducted in English. This does not restrict your right as a consumer to approach a Consumer Disputes Redressal Commission.

17. Severability and waiver

If any clause is held unenforceable, the rest continues in force. A delay in enforcing a right is not a waiver of it.

18. Governing law and jurisdiction

These terms are governed by the laws of India. Subject to the arbitration clause above, the courts at [Courts of jurisdiction (city) — NOT SET] have exclusive jurisdiction.
